- “Platform” means the digital marketplace operated by Crack On Mate.
- “User” means any individual or entity accessing or using the Platform.
- “Seller” means any User listing tools, materials, equipment, goods, or services for sale or rent.
- “Buyer” means any User purchasing or renting such items or services.
- “Listing” means any item or service posted by a Seller on the Platform.
- “Transaction” means any sale, rental, or subcontracting agreement formed between Users.
- “User Content” means all content uploaded or made available by a User.
- Proof of identity or address
- Bank or payment-method verification
- Proof of item ownership
- Business documentation
- Suspension or removal of Listings
- Temporary or permanent account restriction
- Freezing or withholding of funds
- List illegal, stolen, hazardous, counterfeit, or non-compliant items
- Misrepresent ownership, condition, or compliance of Listings
- Circumvent or manipulate Platform fees
- Engage in abusive, harassing, or fraudulent behaviour
- Upload viruses, scrape data, or disrupt Platform services
- Manipulate reviews or Ratings
- A dispute or chargeback is active
- Verification procedures are incomplete
- Fraud, illegality, or platform misuse is suspected
- Regulatory compliance requires it

These Terms & Conditions (“Terms”) constitute a legally binding agreement between Crack On Mate UK Ltd, a company incorporated in the United Kingdom (“Crack On Mate”, “we”, “us”, “our”), and any individual or entity accessing or using the Crack On Mate online marketplace available at CrackOnMate.com (“Platform”).
By creating an account, accessing the Platform, or participating in any transaction, you acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you do not agree, you must immediately cease all use of the Platform.
These Terms apply to all users, including Buyers, Sellers, Renters, Service Providers, and Visitors.

2. CONSUMER RIGHTS & DISTANCE SELLING
Nothing in these Terms shall exclude, limit, or otherwise affect any statutory rights or remedies available to consumers under the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, or any other applicable consumer protection legislation, to the extent that such rights or remedies cannot lawfully be excluded or restricted.
Where a Seller is acting in the course of business, Buyers may be entitled to exercise a statutory right to cancel certain distance contracts within a period of fourteen (14) days from delivery of the goods or commencement of the services, subject to any applicable statutory exceptions or conditions.
In the event of any inconsistency or conflict between these Terms and any applicable consumer protection legislation, the relevant statutory consumer rights and protections shall prevail.
3. ROLE OF CRACK ON MATE
3.1 The Platform operates as a marketplace facilitator only. Except where expressly stated, Crack On Mate is not a party to any Transaction between Users.
3.2 All contractual obligations arising from a Transaction are strictly between the Buyer and the Seller. We do not guarantee the accuracy, legality, quality, condition, or safety of any Listing.
3.3 Users transact entirely at their own risk, and Crack On Mate bears no responsibility for representations made by Users.
4. USER ELIGIBILITY & ACCOUNT REGISTRATION
4.1 The Platform is intended for use by individuals aged 18 years or over.
4.2 Persons under the age of 18 are prohibited from entering into Transactions on the Platform.
4.3 Any attempted registration or use of the Platform by a minor requires verified parental or guardian consent, failing which Crack On Mate reserves the right to suspend or terminate the account.
4.4 Users agree to provide accurate, complete, and current information during registration, and to promptly update such information where necessary.
4.5 Each User may maintain only one account, unless expressly authorised by Crack On Mate.
4.6 We reserve the right to suspend, restrict, or terminate any account where fraudulent, misleading, illegal, or harmful activity is suspected.

Crack On Mate reserves the right, at its sole discretion, to remove, restrict, or moderate any content or Listings that breach these Terms, applicable law, or platform standards, in order to maintain platform integrity and legal compliance.
7. LISTINGS & SELLER OBLIGATIONS
7.1 Sellers warrant that all Listings are accurate, lawful, complete, and comply with applicable UK regulations, including CE/UKCA conformity where required.
7.2 Sellers must ensure they possess legal ownership of the items listed and have the right to sell or rent them.
7.3 Crack On Mate reserves the right to edit, remove, or decline Listings that are misleading, unsafe, unlawful, or inconsistent with platform standards.
8. PAYMENT PROCESSING & FEES
8.1 All payments are processed through authorised third-party payment providers.
8.2 Crack On Mate shall deduct applicable commissions and fees from Seller payouts as specified in the Seller Terms.
8.3 We reserve the right to withhold, delay, or freeze payouts where:

9. DELIVERY, COLLECTION & TRANSFER OF RISK

11. SUBCONTRACTED SERVICES
11.1 Service providers operate independently and are not agents or employees of Crack On Mate.
11.2 Crack On Mate does not verify qualifications, skills, or workmanship and accepts no liability for service outcomes, delays, or deficiencies.
12. RETURNS & REFUNDS
All returns and refunds are governed by the Crack On Mate Returns & Refunds Policy, which forms an integral part of these Terms.
13. INTELLECTUAL PROPERTY RIGHTS
13.1 All proprietary rights in the Platform, including trademarks, logos, software, and content, are owned exclusively by Crack On Mate.
13.2 By uploading User Content, Users grant Crack On Mate a worldwide, irrevocable, royalty-free licence to use, reproduce, distribute, and display such content for operational and marketing purposes.
14. INDEMNIFICATION
Users agree to fully indemnify and hold harmless Crack On Mate, its affiliates, officers, and employees from any claims, losses, liabilities, damages, costs, or expenses arising from:

Users must first attempt to resolve disputes privately and in good faith.

Crack On Mate may, without obligation, review the dispute and provide non-binding guidance.
18.3 Chargebacks
Initiation of a chargeback may lead to account restriction, and Sellers may have payouts withheld until resolution.
18.4 Consumer Rights
Nothing in this section limits or restricts a consumer’s right to pursue legal remedies under applicable consumer protection legislation.
Consumers may, where eligible, refer disputes to an approved Alternative Dispute Resolution (ADR) provider.
18.5 Governing Law & Jurisdiction
Subject to mandatory consumer rights, these Terms shall be governed by and interpreted in accordance with the laws of England & Wales, and disputes shall be subject to the exclusive jurisdiction of the courts of England & Wales.
19. ACCESSIBILITY & EQUALITY
Crack On Mate is committed to complying with the Equality Act 2010 and applicable accessibility legislation.
We will take reasonable steps to provide reasonable adjustments to ensure accessibility for disabled users using the Platform.
20. FORCE MAJEURE
Crack On Mate shall not be liable for any failure or delay arising from events beyond its reasonable control, including but not limited to:
