By accessing, browsing, renting, purchasing, selling, or providing services through the Platform, you (“User”, “Buyer”, “Seller”, “Renter”, “Service Provider”, “Contractor”) irrevocably accept and agree to the terms of this Disclaimer.

1. MARKETPLACE FACILITATOR ONLY

1.1 Crack On Mate acts solely as an online marketplace facilitator. Unless expressly stated otherwise, Crack On Mate is not the manufacturer, owner, supplier, operator, contractor, or service provider of any goods, tools, equipment, building materials, or services listed on the Platform.

1.2 All Listings are created, controlled, managed, and supplied exclusively by independent third-party Users.

1.3 Any transaction entered into through the Platform constitutes a direct contractual relationship between the Buyer/Renter and the Seller/Service Provider.

1.4 Crack On Mate does not supervise, oversee, or control any User’s business activities or the execution of any transaction.

2. NO WARRANTIES, GUARANTEES OR REPRESENTATIONS

• complies with PUWER, LOLER, COSHH, CDM Regulations, or any statutory safety standard;
• is free from defects, hazards, faults, or contamination;
• will function without interruption or malfunction;
• is appropriate for the User’s intended purpose or project requirements.

3. NO VERIFICATION OR VETTING OF USERS OR LISTINGS

3.1 Crack On Mate does not conduct verification, vetting, inspection, certification, or due diligence of:

• Seller identity, qualifications, licences, or insurance status;
• ownership, authenticity, or legality of tools, equipment, materials, or goods;
• accuracy, completeness, or legality of Listings or claims made within them;
• competence, experience, or professional capability of Service Providers or contractors.

3.2 Users bear full responsibility for performing their own due diligence prior to entering any transaction.

4. USER-GENERATED CONTENT DISCLAIMER

4.1 All content displayed in Listings—including descriptions, specifications, photographs, certifications, claims, and pricing—is provided solely by Users.

4.2 Crack On Mate does not monitor, audit, approve, endorse, or guarantee the truthfulness, accuracy, or legality of such content.

4.3 Users rely on user-generated content entirely at their own risk.

5. SAFETY, REGULATORY COMPLIANCE & OPERATIONAL RISK

5.1 Tools, machinery, electrical equipment, and building materials inherently involve operational hazards. Users understand and accept that:

• incorrect or unskilled use may result in severe injury, death, or property damage;
• improper installation or operation may cause equipment failure;
• compliance with safety law is the User’s sole obligation.

5.2 Crack On Mate expressly disclaims all liability arising from:

• unsafe, negligent, or improper use of equipment;
• failure to comply with statutory obligations or industry standards;
• damage to property, machinery, tools, site infrastructure, or third parties.

5.3 Users are solely responsible for complying with:

• PUWER, LOLER, COSHH, CDM Regulations;
• building regulations and construction site rules;
• any licensing or certification requirements;
• appropriate PPE and risk-assessment obligations.

Crack On Mate offers no assurance that any Listing satisfies these requirements.

6. NO TECHNICAL, PROFESSIONAL, OR CONSTRUCTION ADVICE

7. TOOL, EQUIPMENT & MATERIALS OPERATIONAL WAIVER

7.2 Crack On Mate shall not be liable for:

• incompatibility with User requirements;

8. COMPLIANCE WITH BUILDING & SAFETY REGULATIONS

Crack On Mate has no responsibility for ensuring that goods, services, or equipment:

• comply with statutory building regulations;
• meet site-specific health and safety standards;
• are appropriate for commercial, structural, or industrial use.

Full compliance rests exclusively with the User.

9. INSURANCE RESPONSIBILITY

9.1 Crack On Mate does not provide, arrange, or guarantee insurance for any transaction.

9.2 Users are independently responsible for obtaining appropriate insurance, including (where relevant):

• public liability;
• equipment or tool insurance;
• property and project insurance;
• personal injury cover;
• professional indemnity insurance for contractors.

Crack On Mate shall not be liable for any uninsured or under-insured losses.

10. THIRD-PARTY SERVICES & EXTERNAL LINKS

10.1 The Platform may integrate with third-party tools, payment processors, identity verification services, or external websites.

10.2 Crack On Mate does not control, endorse, or guarantee such third-party services.

10.3 Users engage with third-party providers strictly at their own risk.

11. AI-GENERATED CONTENT (If Applicable)

11.1 Any artificial intelligence-generated insights, automated messaging, or recommendations provided on the Platform are for informational purposes only.

11.2 Crack On Mate makes no warranty regarding accuracy, completeness, or suitability of AI-generated output.

11.3 Users must independently verify all information prior to reliance.

12. PLATFORM AVAILABILITY & SYSTEM INTERRUPTIONS

12.1 Crack On Mate does not guarantee continuous, secure, or error-free operation of the Platform.

12.2 Scheduled maintenance, system upgrades, hardware failures, cyber incidents, or external disruptions may temporarily affect access.

12.3 Crack On Mate shall not be liable for losses arising from Platform unavailability or service interruptions.

13. CYBERSECURITY & DATA RISKS

13.1 Crack On Mate shall not be liable for loss, alteration, unauthorised access, or disclosure of User data arising from cyberattacks, system breaches, or events beyond reasonable control.

13.2 Users must maintain robust security practices, including secure passwords and device protection.

14. INDEPENDENT CONTRACTOR STATUS

All Sellers, Renters, and Service Providers act as independent parties.
No agency, partnership, employment, joint venture, or fiduciary relationship is created between Crack On Mate and any User.

15. LIMITATION OF LIABILITY

To the fullest extent permitted by law:

15.1 Crack On Mate shall not be liable for any:

• direct, indirect, incidental, consequential, exemplary, or special damages;
• personal injury, death, or property damage;
• financial loss, business interruption, or loss of profits;
• defects, hazards, or failures in goods, rentals, materials, or services;
• reliance on inaccurate or incomplete Listings or user-generated content.

15.2 Nothing in this Disclaimer excludes liability where such exclusion is prohibited by law, including liability for death or personal injury resulting from negligence.

16. USER INDEMNITY

Users agree to indemnify, defend, and hold harmless Crack On Mate from any claim, liability, loss, damage, cost, penalty, fine, or legal expense arising from:

• breach of this Disclaimer or the Platform Terms;
• unsafe or unlawful use of tools, equipment, or materials;
• misrepresentation, fraud, or misconduct;
• Listing inaccuracies or defective services;
• violations of UK law or regulatory requirements.

17. CONSUMER RIGHTS

Nothing in this Disclaimer shall limit, exclude, or otherwise affect any statutory rights of Consumers under UK law, including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

18. INTELLECTUAL PROPERTY

Crack On Mate bears no responsibility or liability for any infringement of intellectual property rights arising from user-generated content, Listings, or materials uploaded by Users.

17. AMENDMENTS

Crack On Mate may amend this Disclaimer at any time.
Continued use of the Platform following publication of any amendments constitutes acceptance of the revised terms.
